ARTICLE XI
The GUARDIANS NATIONAL FRATERNAL COMMISSION (GNFC)


Section 1 The Guardians National Fraternal Commission shall be the governing body for the quasi-judicial functions and fraternal activities of the Guardians National Triumvirate. It shall be referred to as the Commission. It shall be composed of all National Founders who are not elected to the National positions.

Section 2 The Guardians National Fraternal Commission serves as an advisory body to the Guardians National Triumvirate.

Section 3 The members of the National Fraternal Commission are appointed by the Prime Minister.

Section 4 The officers of the Guardians National Fraternal Commission are as follows:

a. Chairman
b. Vice Chairman for Administration
c. Vice Chairman for Operation
d. Executive Commissioner
e. Commissioner, Appointment Tribunal
f. Commissioner, Election Tribunal
g. Commissioner, Justice Tribunal
h. Commissioner, Security Tribunal
i. Commissioner, Audit Tribunal

Section 5. The powers and functions of the Commission shall be as follows:

1. Exercise administrative control over the various offices of the Commission.

2. Decide on the legality and constitutionality of policies, promulgated rules and regulations, standards and procedure in cases of deadlock and questions raised on such issues, as a quasi-judicial body based on sound professional concepts and principles.
3. Resolved conflicts of the officers occupying higher positions as forwarded by lower bodies.
4. Conduct nationwide inspections for proper evaluation of the efficiency and effectiveness of all organized chapters in the District/Municipal level in coordination with the Regional & Provincial/City Fraternal Commission. This shall only be done upon request of the Guardians National Triumvirate.
5. Report of its activities and accomplishment during the National Convention/Assembly.
6. Perform such other duties and functions necessary to help the other elected and appointed officers of this organization upon request of the National Triumvirate

Section 6. Duties and functions of the Officers of the Commission:

a. CHAIRMAN:

1. He is the Head of the Commission.
2. Consults the Prime Minister on matters relative to the power of general supervision over the Commission.
3. Exercise supervision and control over the various offices under the commission.
4. Delegates authority to exercise any substantive or administrative matters
5. Perform such other functions as assigned by the Prime Minister as promulgated by the Guardians Parliament.

b. VICE CHAIRMAN FOR ADMINISTRATION:

1. He/She shall assist the Chairman on any matters in the performance of his/her duties.
2. He /She shall supervise the appointment Tribunal and the Election Tribunal.
3. He/She shall performed other task that maybe assigned to him/her.

c. VICE CHAIRMAN FOR OPERATION:

1. He/She shall assist the Chairman on any matter in the performance of his/her duties.
2. He/She shall supervise the Justice Tribunal, the Security Tribunal and the Audit Tribunal.
3. He/She shall perform other task that may be assigned to hi/her from time to time.

d. EXECUTIVE COMMISSIONER:

1. Coordinates The works of other Commissioners;
2. Study the Formulation of Standard Operating Procedures ( SOP) approved the Guardians Parliament and inform the Commission in cases of conflict and unconstitutionality of such and announces all rules and regulation that has been approved and passed;
3. Keeps the Chairman and Commissioners inform on matters affecting the situation;
4. Represents the Chairman when authorized;
5. Receives the Commissions decision and insures that they are implemented;
6. Insures establishment of the required liaison;
7. Exercises overall direction of the staff representatives in the Commission Operation Center (COC);
8. Perform other duties that may be assigned to him/her from time to time.

e. COMMISSIONER, APPOINTMENT TRIBUNAL:

1. He/She shall pass upon and attest all appointments made according to regulations provided by the Association;
2. He shall decide all administrative questions affecting appointments extended by the Prime Minister;
3. He/She shall perform other duties as directed by the Chairman.

f. COMMISSIONER, ELECTION TRIBUNAL:

1. He/She shall have exclusive charge of the enforcement and administration of all regulations relative to the conduct of elections;
2. He/Shall decide, save those involving the right to vote, all administrative question affecting elections, including the determination of the number and location of polling places and the appointment of Election officers and other election officials and members;
3. He/She shall perform other duties as directed by the Chairman.

g. COMMISSIONER, JUSTICE TRIBUNAL:

1. He/She shall deal with the administrative and disciplinary machinery of the Association;
2. He/She shall have jurisdiction to review the decision, orders, and rulings of the election Tribunal;
3. He/She shall supervise such inferior bodies that may be established by the Association;
4. He/She has jurisdiction to review, revise, reverse, modify or affirm an appeal, final decisions of the inferior bodies in;

a. All cases in which the constitutionality or validity of any resolution, circular, regulations, decision, or implementing order is in question;
b. All cases in which the jurisdiction of any inferior body is in issue;
c. All administrative cases in which the penalty imposed is expulsion from the Association;

5. He/She shall recommend filing of appropriate legal action for any unauthorized, unlawful use of name, markings and logo of the GBI that would undermine or destroy the integrity and name of the organization committed by non-members or expelled members of the organization to the Prime Minister.

h. COMMISSIONER, SECURITY TRIBUNAL:

1. He/She shall have exclusive charge of the enforcement and

2. administration of all regulations relative to the security of all officers and members of the Association;
3. He/She shall conduct investigation and initiate the prosecution of all offenses in violation of this By-Laws, and infractions of existing regulations;
4. He/She shall perform other duties as directed by the chairman.

i. COMMISSIONER, AUDIT TRIBUNAL

6. He/She shall conduct account examination, audit and settle all accounts pertaining to the revenues, receipts and expenditures of the association, or any of its subdivision, agencies, or any instrumentalities in cases of conflicts and as part of investigation of cases filed before the commission that concerns finances of the association.
7. He/She may adopt measures necessary to correct the deficiencies of the audited chapters, agencies or units;
3. He/She shall perform all other functions as directed by the Chairman.
